5.16 Leaves of Absence

All leaves must be requested and approved in accordance with this UHV Policy C-01. The leave must be approved by the employee’s supervisor (or designee), unless a requirement for higher approval is noted. Leaves may be granted for such purposes as research and writing, education, other personal development, or extended illness, according to System guidelines. Leaves will be limited in duration to 12 months.

Leave Requests and Absence Requests:  An Absence Request/Notification is an electronic submission processed in PASS by the employee and approved by the employee’s supervisor or designee.

Unless otherwise provided by state law or agreement between the university and the employee, the following apply to leaves of absence and shall be clearly communicated to all faculty and staff:

  1. Seniority is not interrupted but pay increases and associated benefits are;
  2. Group insurance may be continued by advance payment of full premiums by the employee;
  3. Teacher Retirement and Optional Retirement programs are suspended unless provided by another eligible employer;
  4. Social Security coverage ceases unless the employee is covered by the employer;
  5. Vacation and sick leave do not accrue;
  6. Funds cannot be withdrawn from Teacher Retirement and Optional Retirement programs;
  7. If required by state law, all accrued paid leave entitlements shall be exhausted; sick leave is included only if the employee is eligible for sick leave;
  8. Leaves will be limited in duration to 12 months; and
  9. Exceptions to these provisions may be granted for such reasons as interagency agreements or educational purposes.

5.16.1 Family and Medical Leave

The University of Houston System provides leave benefits to eligible employees in accordance with the Family and Medical Leave Act of 1993, as amended, (FMLA) and related Department of Labor regulations and the General Provisions of the State General Appropriations Act.  This policy defines and describes University of Houston-Victoria (UHV) leave benefits available to eligible employees under these laws and in accordance with System Administrative Memorandum 02.D.06. 5.16.2 Parental Leave

This policy describes the parental leave benefits that the State of Texas provides to eligible employees in accordance with the General Provisions of the State General Appropriations Act and Texas Government Code, Section 661.913. This policy complies with University of Houston System Administrative Memorandum 02.D.08. (References)

UHV employees who have not met the employee eligibility requirements for the Federal Family and Medical Leave Act (FMLA) are entitled to parental leave for the following qualifying conditions:

Leave taken for these events must be reported as parental leave.

The eligible employee is entitled to a maximum of 12 weeks of approved parental leave in a year, as defined in this policy.  The employee may take a shorter leave.  Employees who meet the eligibility requirements of parental leave are entitled to benefits under UHV Policy C-26, Family and Medical Leave.

5.16.3 Leave of Absence Without Pay

Leaves without pay of 30 days or less may be granted with the approval of the employee's supervisor (or designee).

A leave of absence without pay for longer than 30 days (other than for military active duty, family and medical leave, parental leave, or workers’ compensation) requires the approval of the employee’s supervisor and the cabinet-level supervisor.

Leaves may be granted for such purposes as research and writing, education, other personal development, or extended illness, according to System guidelines. Leaves will be limited in duration to 12 months.
